Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Green Light Landscape Lighting (“Company,” “we,” “our,” or “us”), owned and operated by Mario Tutino and Vittorio Pugliese.

By accessing our website at greenlightlandscapelighting.com, requesting a consultation, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Services Provided

Green Light Landscape Lighting provides professional permanent RGB landscape lighting installation and related services, including but not limited to:

• Permanent RGB LED lighting installation
• Architectural and facade lighting
• Landscape and garden illumination
• App-controlled smart lighting systems
• Holiday and seasonal lighting programming
• Lighting system maintenance and repairs
• Consultation and design services

Services are provided in New York and New Jersey. Service availability in specific areas is subject to confirmation during the consultation process.

Consultations & Estimates

We offer free consultations and estimates for our services. Please note:

• Consultations are scheduled based on availability and service area
• Estimates are provided based on the information available at the time of assessment
• Final pricing may vary based on actual conditions discovered during installation
• Estimates are valid for 30 days from the date issued
• We reserve the right to adjust pricing if project scope changes

Pricing & Payment Terms

Pricing

All prices are quoted in US dollars and are subject to applicable taxes. Pricing is determined based on:

• Property size and complexity
• Type and quantity of fixtures required
• Installation difficulty and accessibility
• Additional features or customizations requested

Payment Schedule

Unless otherwise agreed in writing, our standard payment terms are:

• Deposit: 50% of the total project cost is required to schedule installation
• Final Payment: Remaining 50% is due upon completion of installation

Accepted Payment Methods

We accept the following forms of payment:

• Cash
• Check
• Credit/Debit Cards
• Bank Transfer
• Digital Payment Services (Venmo, Zelle, etc.)

Late Payments

Payments not received within 15 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance. We reserve the right to suspend services or pursue collection for overdue accounts.

Scheduling & Installation

Scheduling

Installation dates are scheduled based on availability and weather conditions. We will make every effort to complete installations as scheduled, but dates may be subject to change due to:

• Inclement weather conditions
• Unforeseen site conditions
• Material availability or delays
• Customer-requested changes

Site Access & Preparation

Customer agrees to:

• Provide clear access to the property and work areas
• Ensure pets are secured during installation
• Clear landscaping or obstacles as reasonably requested
• Provide access to electrical panels when required
• Ensure someone 18+ is available during installation

Installation Process

Our installation team will:

• Arrive within the scheduled time window
• Complete work in a professional and timely manner
• Clean up the work area upon completion
• Demonstrate system operation and provide instructions
• Test all components before leaving

Warranty & Guarantees

Product Warranty

All lighting fixtures and components come with the manufacturer’s warranty, which typically includes:

• LED fixtures: Varies by manufacturer (typically 5-15 years)
• Controllers and transformers: Manufacturer’s standard warranty
• Wiring and connectors: Manufacturer’s standard warranty

Installation Warranty

Green Light Landscape Lighting provides a 1-year workmanship warranty covering:

• Installation defects and errors
• Connection and wiring issues
• Mounting and fixture placement problems

Warranty Exclusions

Warranties do not cover damage caused by:

• Acts of nature (lightning, flooding, extreme weather)
• Power surges or electrical issues beyond our control
• Unauthorized modifications or repairs
• Neglect, misuse, or accidental damage
• Normal wear and tear
• Third-party interference or vandalism

Cancellation & Refund Policy

Cancellation by Customer

• More than 7 days before installation: Full refund of deposit
• 3-7 days before installation: 50% of deposit refunded
• Less than 3 days before installation: Deposit is non-refundable
• After installation begins: No refund; payment for completed work is due

Cancellation by Company

We reserve the right to cancel or postpone services due to:

• Unsafe working conditions
• Customer non-compliance with these Terms
• Non-payment or payment issues
• Circumstances beyond our control

If we cancel for reasons not caused by the Customer, a full refund of any deposits will be provided.

Limitation of Liability

To the fullest extent permitted by law:

• Our total liability for any claim arising from our services shall not exceed the amount paid by you for those services
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We are not responsible for damage to underground utilities, sprinkler systems, or other buried items not disclosed prior to installation
• We are not liable for delays or failures caused by circumstances beyond our reasonable control

Indemnification

You agree to indemnify and hold harmless Green Light Landscape Lighting, its owners, employees, and contractors from any claims, damages, or expenses arising from:

• Your breach of these Terms
• Your misuse of the installed lighting system
• Inaccurate information provided by you
• Unauthorized modifications to the system

Property & Permits

Property Ownership

By engaging our services, you represent and warrant that:

• You are the property owner or have authorization from the owner
• You have the right to authorize installations on the property
• The installation does not violate any HOA rules, covenants, or local regulations

Permits

Most permanent lighting installations do not require permits. However:

• Customer is responsible for obtaining any required permits
• We can assist in identifying permit requirements upon request
• Additional fees may apply for permit-related services

Intellectual Property

All content on our website, including text, images, logos, and designs, is the property of Green Light Landscape Lighting and is protected by copyright and trademark laws. You may not:

• Reproduce, distribute, or modify our content without permission
• Use our trademarks or branding without authorization
• Copy our designs or proprietary methods

Photography & Marketing

We may request permission to photograph completed installations for our portfolio and marketing materials. You have the right to decline. If you consent, we will not disclose your personal information without additional permission.

Dispute Resolution

In the event of any dispute arising from these Terms or our services:

1. Direct Communication: Contact us directly to discuss and resolve the issue
2. Mediation: If direct communication fails, parties agree to attempt mediation before pursuing legal action
3. Governing Law: These Terms are governed by the laws of the State of New Jersey
4. Jurisdiction: Any legal proceedings shall be conducted in the courts of New Jersey

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website or services after changes constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically for updates.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with any written estimates, contracts, or agreements provided, constitute the entire agreement between you and Green Light Landscape Lighting regarding our services. Any prior discussions, representations, or agreements not included herein are superseded.
